While they’re doing that, we’re going to be gathering the information we need to prosecute their claim, we will be gathering evidence, talking to witnesses, if necessary, talking to the doctor’s office if necessary, and compiling evidence to present the claim to the insurance company.

There is really nothing the client has to do themselves. Just keep in touch with us, call with any questions and make sure to touch base every two to three weeks.

Is It Advisable For People To Refrain From Posting Anything Related To The Case On Social Media Sites Like Twitter Or Facebook?

Absolutely! Whenever an accident happens, people post a lot of stuff on social media. For example, maybe they’ve told their doctor that they have excruciating back pain and trouble sleeping at night or difficulty walking and standing for any extended period of time. Then, what do you know, they go and post a picture of themselves at a friend’s birthday party and talk about what a great time they had.  The picture shows them holding a bottle of beer and dancing up a storm. Granted they may have only been up for 30 seconds until they had to sit down again, but there is that picture of them having a great time at a party.

The insurance company will perform a search on social media. If they find that picture – and they will — they’re going to make a big deal out of it and ultimately that will hurt the claim.  If the claim can’t be settled, and the case goes to trial, that picture will be shown to a jury who will have to decide whether or not they believe you that you are in pain or that photo.

Once you put it out there on social media, whether it’s words or pictures, you can’t get rid of it. It stays there forever. My best suggestion is just don’t do it.
